Bank drafts offer a convenient and secure means of payment, and are more easily negotiated than postal money orders and are less vulnerable than cash to loss or theft.
MAUBANK TERMS AND CONDITIONS FOR DEBIT CARDS
1. DEFINITIONS AND INTERPRETATIONS
- "The Bank", "our”, "us" or "we" means MauBank
- "Card Account(s)" means the account/s designated by the Cardholder in the books of the Bank, to which account(s) all transactions effected with the use of the Card shall be
- "The Card" means the Visa Debit Card issued to a Cardholder by MauBank Ltd under the Terms and Conditions of the present
- "The Cardholder" means the individual to whom the Card has been issued under this
- "PIN" means the Personal Identification Number issued by MauBank to the Cardholder.
- ‘’Validity Date’’ – The expiry date of the Card as printed on the Card.
- "Transaction" means any goods or services paid for with the Debit Card at Merchant/s or any Cash Withdrawal effected from any ATM, all of which are within the authorised
- "ATM" means the Automated Teller Machine located in Mauritius or abroad and displaying the Visa logo.
- "POS" means any authorised establishment/merchant displaying a Visa logo and equipped with a terminal to accept Cards for
- "Account Holder” mean s the person /s whose account/ s shall be debited for all transactions effected with the Debit Card.
- ‘’Chip’’ Integrated circuit that may be embedded in a Card and which is designed to perform processing and/or memory functions’’
- ‘’CVV’’ Card Verification Value relates to the last 3 digits at the back of the card.
- ‘’Card Not Present Transaction’’ means transaction payment without the Card being physically presented at time of transaction including but not limited to online payments, mail order and transactions via telephone.
- “Contactless Transaction” – Transaction processed with Tap and Pay functionality at a contactless enabled POS terminal with or without requiring the Cardholder to input his PIN to authorize the transaction, subject to the transaction threshold applied by MauBank
- “Contactless Reader” - Secure reader installed within a POS terminal through which contactless purchases may be made.
- “Terminal limit” is the limit which has been set by the Merchant’s Bank on the POS terminal to accept Contactless payment.
- ‘’3D Secure Services’’ refers to online authentication services catered by Visa to facilitate secure Card Not Present Transactions at participating 3D secure online merchants displaying the ‘Verified by Visa’ logo
- ‘’MauBank Secure Token’’ – Free App which can be downloaded from App Store and PlayStore and allows the cardholder to generate the One Time Password (OTP) required for authentication of transactions at online merchants displaying the ‘Verified by Visa’ logo.
2. ACCEPTANCE OF THIS AGREEMENT
- "This Agreement governs the Terms and Conditions of the use of the Debit Card issued by MauBank Ltd. It is imperative that you read and understand this Agreement before you sign and agree to
However, upon immediate use of the Card it is implied that you undisputedly submit yourself legally to all the Terms and Conditions of this Agreement.
3. PURPOSE OF THE CARD
The Card enables its holder:
- To withdraw cash from any ATM/s in Mauritius and/or abroad, in the currency of the country provided the VISA logo is displayed and subject to the Daily Transaction Limit determined by the Bank or the available balance in the Card Account whichever is
- To pay electronically for goods and/or services in Mauritius and/or abroad in the currency of the country at POS displaying the Visa logo.
- To deposit cash/cheques in special envelopes through selected MauBank's ATM/s to be credited to the Cardholder's account or instant cash deposit at selected MauBank’s ATM/s.
- To obtain balance/mini statement on the Card account/s through MauBank's ATM/
- To effect transfer between accounts linked to the Card through MauBank's ATM/
- To access other services such as Mobile Recharge and PIN change and display through MauBank's ATM/
4. ISSUE OF THE CARD
- The Card is the exclusive property of the Bank and is for the sole use of the Cardholder.
- The Card shall be forthwith returned to the Bank upon closure of the account, death of the Cardholder or when called upon by the Bank.
- The Bank reserves the right to reject any application without assigning any reason whatsoever for such rejection.
- The Card is not transferable and cannot be pledged or charged as security in any manner whatsoever.
- On receipt of the Card the Cardholder shall sign with a ball pen on the reverse of the Card in the space provided for, as per his/her signature appearing on the Application Form for the Debit Card. In case the unsigned Card is lost/stolen/misplaced the Cardholder shall be liable for all transaction /s incurred on it.
- The Cardholder shall use the Card in a satisfactory manner and shall be responsible for the safeguarding of both Card and PIN.
- The Cardholder may only disclose the Card number for the purpose of a transaction or when reporting the loss or theft of the Card or when the Bank authorises such disclosure.
- The Card is free of charge except for replacement card.
- In case of replacement, the Bank shall charge a fee as per the Bank Tariffs guide prevailing at the time.
5. PERSONAL IDENTIFICATION NUMBER (PIN)
- A PIN shall be allotted by the Bank to the Cardholder and communicated confidentially to the Cardholder.
- The Cardholder should avail the facility to change the PIN as a security precaution from time to time through any MauBank's ATM/s or through MauBank WithMe App.
- The Cardholder is responsible for the safekeeping and proper use of his/her Card and PIN.
- The PIN is essential for accessing ATM services and to effect payment at POS.
- Should the Cardholder believe that the PIN may have been compromised, the Cardholder should immediately inform the Bank through its Hotline (230) 404 0330.
- The Cardholder shall nevertheless be liable to MauBank for any transaction/s effected by the use of the Card by any other person who acquired possession of it with or without the Cardholder's consent before such notice is received as if the Cardholder had used it personally.
6. USE OF THE CARD
- The Card shall be issued inactive by the Bank and sent by post to the customer’s registered address.
- The Cardholder shall be responsible for activating the Card through MauBank WithMe App or by calling on the Hotline (230) 404 0330 during banking hours.
- The Cardholder shall use the Card and operate the account/s in a satisfactory manner, as required from time to time by the Bank. The decision as to whether the Card is being so used rests exclusively with the Bank and shall be conclusive and binding on the Account holder and on the Cardholder.
- The Bank shall not be liable for any action in the event any merchant or establishment is unable to honor or accept the Card.
- All transaction(s) shall be debited to the Card account/s with related Bank charges, if any.
- Before using the Card, the Cardholder shall ensure there are sufficient funds available in the Card account/s to cover the payment/s of the transaction/s. Furthermore, the Cardholder will not operate the Card account/s in such a way to exceed the available balance of the Card account/s.
- In case of cheque deposits, the Cardholder shall ensure the correctness of the amounts written on and contained in the deposit envelopes. Any cheque/s deposits shall be accepted for collection only and the proceeds shall not be available until the cheque/s has/have been cleared, the proceeds paid to the Bank by the paying Bank and credited to the Card account.
- Cash deposits shall only be credited to the Cardholder's account after proper verification and shall be conclusive and binding. Such cash deposits shall be regarded as having been received by the Bank upon it being credited to the Cardholder's account.
- Cash withdrawals and balance inquiry shall be allowed through other Banks' ATM/s, subject to handling charges, if any, which shall be debited to the Card account/s.
- The Cardholder shall ensure that the CHIP on the Card is protected at all times from misuse including tampering damage, destruction or any form of unauthorised use and is kept clean at all times.
- The Bank shall not be liable if a transaction cannot be processed as a result of a merchant POS terminal not being correctly configured or for any other cause.
7. Contactless Transaction Processing

- For the purpose of Contactless Transaction Processing:
7.1.1 A Card transaction processed with Tap and Pay functionality at a contactless enabled POS terminal with or without requiring the Cardholder to input his PIN to authorize the transaction, subject to the transaction threshold applied by MauBank.
- A Contactless payment method via Visa network can be performed at any POS terminal, which displays both the Visa and contactless logo.
- Contactless Transactions are also subject to the Card Limits, which shall be revised by MauBank from time to time as available on MauBank’s website and in MauBank Business Centres.
7.1.4 Contactless Transactions are also subject to the POS terminal limits, which shall be set by the Merchant’s Acquiring Bank.
7.1.5 If Contactless Transaction exceeds one or more of the limits, the Cardholder shall still make the purchase by swiping or inserting the Card into the reader/terminal and inputting his PIN.
- The cardholder shall be liable for all contactless transactions that have been effected with his Card. MauBank shall not in any way whatsoever be liable for such contactless transactions save and excepted when the Cardholder has reported that his card has been stolen or lost.
8. Temporary Block on Card/Card Functionality

- Only the Cardholder can apply or request for a temporary block on his Card.
- The Cardholder may update his Card settings via MauBank WithMe – (MauBank Mobile Banking application). The Cardholder may temporary block his Card to restrict:

Online Payments
The card itself, in case it has been misplaced to prevent unauthorized use by temporarily block the card.
The Cardholder may at any time, allow back these types of transactions by updating his Card settings.
- If you choose to temporarily block the Card, you should be aware that blocking the card temporarily does not report the Card as being lost or stolen.
- MauBank shall not be liable for any loss that you may suffer if a transaction is declined because it matches one of the temporary block you have set, including any subsequent loss of goods and/or services if the Merchant is unable to process the transaction.
- We rely on the information about a transaction that a merchant or financial institution provides us to determine whether the transaction matches one of the transaction types you have blocked. If, for example, you chose to block POS transaction but the merchant incorrectly processes the transaction as an Online Payment, the transaction will not be blocked.
- The cardholder acknowledges that the temporary block function is reliant on computer, and/or telecommunications systems. Disruptions to these systems may result in the temporary block function, setting and removing temporary block being unavailable from time to time.
9. LOSS OR THEFT OF THE CARD
- The cardholder undertakes to exercise the utmost care to prevent the Card from being lost. However, in case of loss or theft, or suspected theft of the Card, the Cardholder shall block the card through MauBank WithMe App or notify the Bank immediately by calling the Card Hotline number on (230) 404 0330.
- In case of loss, theft or suspected theft of the Card, the Bank may further request the Cardholder to report the matter to the police and to produce such proof thereof to the Bank.
- In case of dispute on the date and time such report was made, the date and time of receipt of written notification by the Bank shall be conclusive. The Cardholder's liability to the Bank shall in all cases last until written confirmation of loss, theft or suspected theft of the Card/PIN is received at MauBank Card Centre.
- In case the loss or theft, or suspected theft of the Card, is communicated by a third party, authorised or not, other than the Cardholder, the Bank shall not be held liable for any resulting damage suffered by the Cardholder.
- A replacement Card shall be issued against payment of fees as per the Bank's Tariffs guide prevailing at the time. Such issuance shall be subject to completion of all formalities, including those referred to in paragraph 7.1 above, and on receiving stolen/lost Card report in the prescribed format from the Cardholder.
- The Cardholder shall indemnify and keep the Bank indemnified at all time against all claims, demands, costs, charges and expenses which may arise by reason of the use/ misuse of the Card or anything related thereof.
- Improper use of the ATM or unsuccessful attempts to key in the correct PIN shall result in the automatic retention of the Card, which the Cardholder shall then recover by calling at the Bank with a proof of identification.
10. FEES
10.1 In case of Card or PIN replacement, the Bank shall charge a fee as per the Bank's Tariffs guide prevailing at the time.
10.2 In case an express request for a Card is made by customer, a fee shall be charged, as per the Bank’s Tariffs guide prevailing at the time.
10.3 All fees and charges may be subject to revision by the Bank and subsequently notified to Cardholders.
11. FOREIGN CURRENCY TRANSACTIONS
- Use of the Card abroad is subject to exchange control regulation in force in the relevant
- Transactions effected in foreign currency by means of the Visa Card shall be debited to the Card account at the appropriate rate of exchange prevailing on the date the debit advices are processed by VISA centre in London, irrespective of the rate prevailing in Mauritius on the date the account is debited plus 2.50% Optional Issuer Fee (OIF).
- The OIF may at any time thereafter be revised by the Bank, irrespective of the date on which the amount is debited to the Cardholder's account in the books of MauBank
12. DURATION OF VALIDITY, RENEWAL AND TERMINATION OF THE CARD
- The Card is valid up to the expiry date borne thereon and shall be renewed, subject to the card being used regularly, prior to its expiry, unless contrary instructions have been given by the Cardholder to the Bank, according to the Bank's procedures in force at the material time.
- The Card shall remain the property of the Bank, which may, in its absolute discretion terminate its validity at any time or refuse to renew it on expiry without having to assign any reason there
- The Bank reserves the right to seize and cancel the Card at its sole discretion, call upon the Cardholder to surrender the Card without assigning any reason there for.
- Until the Cardholder notifies the Bank, according to Section 9 (Loss/theft), the Cardholder shall be liable for all transactions effected with the Card and shall remain liable in cases of gross negligence or dishonest use of the Card by himself or any other person who acquired possession of his Card with or without his consent and the Cardholder shall indemnify the Bank for all loss or damage whatsoever.
- The fraudulent, incorrect, illegal use of the Card by either the Cardholder or the Account Holder or any other party, shall not relieve the Account Holder of his liabilities to MauBank in respect thereof.
- Services allowed with the Card may vary from time to time and country to country. The Bank shall not be liable for unavailability of such services in other countries or on other Bank's
- The Bank and the firm responsible for the maintenance of the ATM and its system shall in no circumstances be liable for the malfunction, temporary breakdown or misuse of the ATM or for any cause which may result in the Card being retained, torn, defaced or rendered unusable in any way and shall not be liable for any consequence resulting from
- The Bank shall not be responsible for refusal at any other ATM/s or POS to accept the Card for any reason
13. DISPUTES
13.1 It is the responsibility of the Cardholder to check his account/s on a regular basis and inform MauBank of any suspicious Transaction as soon as reasonably practicable.
13.2 The Bank shall not be responsible to the Cardholder for any dispute arising between the Cardholder and any merchant/s in respect of goods or services supplied to the Cardholder and for which payment have been settled with the Card. Such disputes shall be settled directly with the merchant/s without the Bank being constituted party thereto.
13.3 No claim or action whatsoever relating to a Transaction shall be entertained beyond 120 days from the date of Transaction.
- Complaints against the merchant should be resolved by the account holder (s) or such person as aforesaid with the Merchant’s Establishment and no claim against the Merchant Establishment will relieve the account holder (s) from any obligation to.
14. COMMUNICATION OF INFORMATION TO THIRD PARTY
- The Bank shall be entitled, should it deem necessary, to pass on to any commercial Bank, Financial Institution or merchant, any information relative to the Cardholder in case of improper or fraudulent use of the Card by the Cardholder or in order to facilitate the recovery of same in case of loss or theft.
15. SANCTIONS
15.1 Any illegal, improper or fraudulent use of the Card shall expose the Cardholder to the withdrawal of his Card and shall render the Cardholder liable to prosecution and or civil action.
15.2 In an action before any court for the recovery of any sum due to the Bank in connection with the use of a Card, the documents relating to the transactions effected therewith or certified photocopies thereof shall be conclusive and irrefutable evidence of the said transactions.
15.3 If more than one-person sign or agree to be bound by these terms and conditions, the obligation of such persons hereunder will be joint and several and, as the context may require, words herein denoting the singular only will be deemed to include the plural. Any notice hereunder to any one such person will be deemed effective notification to all such persons.
- In case of fault or negligence of a Cardholder in the safe keeping of his Card or PIN the Bank shall be entitled to report the matter to the police and to claim damages from the Cardholder jointly and severally with the account holder even though either of them has reported the loss, theft or suspected theft of the Card.
- Holders of joint accounts to which Card transactions are posted shall be jointly and severally liable for damages resulting from the responsibility of the Cardholder.
- The Bank's record of transactions processed by the use of the Card or their reproduction on a computer base shall be conclusive and binding for all
- No claim or action whatsoever from a Cardholder relative to a Card transaction shall be entertained after the expiry of 30 days from the date the statement of account whereon the transaction is
16. MAIL AND FAX DISCLAIMER
16.1 The undersigned authorises and instructs the bank to act on any Message received either by telephone by facsimile transmission or telex (a message or messages) and or any other mode of communication including telecommunication, internet, e-mail, without limitation as to mode subject to existing terms and conditions of the Bank relative to such Mail and Fax Disclaimer without the need for further verification.
- The undersigned agrees that the use of this service will bind the undersigned legally and make the undersigned responsible to the same extent and effect as if the undersigned had given original signed written instructions to the Bank.
- The undersigned acknowledges that any Message the Bank acts upon will be conclusively deemed to be valid instructions, whether or not authorised by the undersigned or whether or not accurately communicated and received. The Bank's records will be conclusive evidence of the Message.
- The Bank may decline or delay acting on any Message for any reason, for example if the instructions in any Message are not correct, incomplete, ambiguous or cannot be carried out due to insufficient funds or otherwise or the lawfulness of any instruction given in any Message or for any cause or reason not specified herein. In any case, the Bank's records shall be conclusive evidence as regards the nature of such communications and the time at which they were received by the bank.
- Neither the Bank nor its correspondents shall be liable for any loss, damage or prejudice of the undersigned may suffer in any transaction made on the authority of a message sent on behalf of the undersigned.
- The undersigned agrees to pay any fees and/or related cost incurred while providing any services through instructions received by such means and the undersigned authorises the Bank to deduct from any of the undersigned's account such amount
- This agreement may be determined by the Bank or the undersigned at any time by written notice to the other party. The undersigned agrees to all above conditions and that this agreement remains in effect until such time as notice of termination has been given in accordance with this agreement.
17. MODIFICATION/S OF PRESENT AGREEMENT
- The Bank may at any time amend the Terms and Conditions hereof and shall notify such amendment/s to the Cardholder accordingly.
- Any notice hereunder sent by post will be deemed to have been received by the Cardholder within 7 days of posting to the address last notified in writing to the Bank by the
- Use of the Card after the date upon which any change to these Terms and Conditions is to have effect (as specified in the Bank's notice) will constitute acceptance without reservation by the Cardholder of such change and be bound thereby unless the Cardholder returns the Card to the Bank within 15 days of such

18. METHODS OF SETTLEMENT

19. UNLAWFUL USE
19.1 The Card must not be used for any unlawful purpose including the purchase of good or services prohibited by local law applicable in the Cardholder's jurisdiction.
